CBSA Concludes Expiry Review Investigation on Carbon Steel Welded Pipe Imports from China

The CITT will now conduct an inquiry to assess the potential injury to the Canadian industry, with a decision expected by December 24, 2024.

The Canada Border Services Agency (CBSA) has concluded its expiry review investigation into the dumping and subsidizing of certain carbon steel welded pipe (CSWP) originating in or exported from the People’s Republic of China.

This investigation was initiated following the Canadian International Trade Tribunal’s (CITT) decision to review its previous order concerning these imports.

With the CBSA’s findings in hand, the CITT’s inquiry will determine whether the expiry of its original order is likely to cause injury to the Canadian industry.

The inquiry is critical to deciding the future of trade measures on these imports. The CITT has announced that it will issue its decision on this matter no later than December 24, 2024.

Background of the investigation

On February 19, 2024, the CITT, under subsection 76.03(1) of the Special Import Measures Act (SIMA), began an expiry review of its March 28, 2019, order made in Expiry Review No. RR-2018-001.

This review was focused on the dumping and subsidizing activities related to certain carbon steel welded pipe imports from China.

Following this, on February 20, 2024, the CBSA initiated its own expiry review investigation to assess whether the order's expiration likely leads to the continuation or resumption of these unfair trade practices.

Findings of the CBSA

The CBSA has now completed its investigation and, pursuant to paragraph 76.03(7)(a) of SIMA, has determined that the expiry of the order is likely to result in:

• The continuation or resumption of dumping of carbon steel welded pipes originating in or exported from China.
  
  
• The continuation or resumption of subsidizing these goods from China.

A comprehensive Statement of Reasons outlining the CBSA’s determinations and the evidence supporting these conclusions will be issued within the next 15 days.

The potential continuation or resumption of dumping and subsidizing carbon steel welded pipe from China poses a threat to Canadian manufacturers.

These practices can lead to unfair pricing and market disruptions, making it challenging for domestic producers to compete.
