How tariff classification works in Canada

Getting your tariff classification right from the start determines your duty costs, your tariff treatment, and your compliance obligations.

Every commercial good imported into Canada must be assigned a **tariff classification** number. That number is a key part of customs accounting and import compliance.

In this article, we explain how Canada's tariff classification system works, how the General Interpretative Rules (GIRs) apply, and what to do when classifying goods becomes challenging.

## **What is tariff classification?**

Tariff classification is the process of assigning a numerical code to imported goods under Canada's [Customs Tariff](https://www.cbsa-asfc.gc.ca/trade-commerce/tariff-tarif/menu-eng.html).

This code determines the [duties](https://blog.coleintl.com/import-foundations/understanding-canadian-import-duties-and-taxes)and other import requirements that apply to your goods, as well as the [tariff treatment](https://blog.coleintl.com/import-foundations/understanding-canadas-tariff-treatments-for-imported-goods) they receive. And, together with [rules of origin](https://blog.coleintl.com/import-foundations/understanding-rules-of-origin-when-importing-into-canada) and supporting documentation, it also determines whether your imports may qualify for [preferential tariff treatment](https://blog.coleintl.com/import-foundations/how-to-claim-preferential-tariff-treatment-with-a-certificate-of-origin) under a free trade agreement.

When you import goods into Canada, the classification number is reported on the Commercial Accounting Declaration ([CAD](https://blog.coleintl.com/import-foundations/how-to-account-for-your-imports-using-the-commercial-accounting-declaration-cad)) as part of your accounting obligations.

## **How the tariff classification system is structured**

Canada’s tariff classification system is based on the Harmonized System (HS), which is an international product categorization used by trading nations around the world.

Canada extends the international 6-digit HS structure through its own tariff items and statistical suffixes to create a 10-digit tariff classification number ([HS code](https://blog.coleintl.com/import-foundations/importing-into-canada-heres-how-to-find-your-hs-code)). The ten-digit number is organized hierarchically, as follows:

- **Chapter** (digits 1–2)
- **Heading** (digits 3–4)
- **Subheading** (digits 5–6)
- **Tariff item** (digits 7–8)
- **Statistical suffix** (digits 9–10)

Canada's Customs Tariff is organized into 99 chapters. **Chapters 1 to 97** cover goods by type and are used for standard tariff classification. **Chapter 98** covers traveller exemptions and goods prohibited from entry into Canada, and **Chapter 99** covers special duty relief provisions for commercial goods.

## **How the General Rules for the Interpretation of the Harmonized System work**

The General Rules for the Interpretation of the Harmonized System (GRIs), commonly referred to as the General Interpretative Rules ([GIRs](https://www.cbsa-asfc.gc.ca/publications/dm-md/d10/d10-13-1-eng.html#s02_3)), are the legally binding rules that govern how goods are classified under Canada’s Customs Tariff. There are six rules, which are applied in sequence:

- **Rule 1:** Classification starts with the wording of the headings and any Section or Chapter Notes. If the heading text clearly describes your goods, the classification is settled here.
- **Rule 2:** A heading that covers a finished article also covers that article when imported incomplete or unassembled, as long as it has the essential character of the finished product. This rule also extends headings that reference a material or substance to include mixtures or combinations.
- **Rule 3:** If goods could fall under more than one heading, the rules resolve the issue by looking first at which heading is more specific, then at essential character, and finally at the heading that appears last in numerical order.
- **Rule 4:** If the earlier rules do not settle the classification, goods are classified under the heading they most closely resemble.
- **Rule 5:** Certain containers, cases, and packing materials presented with the goods are generally classified with them, unless the container is clearly suitable for repetitive use.
- **Rule 6:** Once the correct heading is identified, the same interpretive approach is used to determine the correct subheading within that heading.

Classification is worked level by level, starting with the heading, then the subheading, and then the tariff item.

## **How to resolve challenging classification**

While Rule 1 resolves most classifications, some goods are harder to classify, especially composite goods, multi-material products, goods that could fit under multiple headings, and items that are imported as incomplete or unassembled.

When classification is unclear, you can request a binding determination through the CBSA's [Advance Ruling program](https://blog.coleintl.com/import-foundations/how-an-advance-ruling-can-simplify-importing-into-canada).

Misclassification can result in penalties, interest, and corrections to previous declarations. You must correct tariff classification errors within 90 days after you have "[reason to believe](https://blog.coleintl.com/blog/why-reason-to-believe-catches-canadian-importers-off-guard)" a declaration was incorrect. Otherwise, you may face interest and [AMPS penalties](https://blog.coleintl.com/import-foundations/avoiding-amps-penalties-when-importing-into-canada).

The wrong classification can also affect SIMA screening and accounting. However, whether [SIMA duties](https://blog.coleintl.com/import-foundations/understanding-sima-duties-and-how-they-are-assessed) apply ultimately depends on the product definition and the scope of the measure. If you've overpaid as a result of a classification error, you may be able to recover those costs through a [refund of duties](https://blog.coleintl.com/import-foundations/how-to-claim-a-refund-of-duties-after-importing).

Remember that, as the [importer of record](https://blog.coleintl.com/import-foundations/what-it-means-to-be-the-importer-of-record-in-canada), you are responsible for the accuracy of your tariff classification, even if a customs broker files on your behalf.
